Rachel S. Fleishman
Partner
Rachel S. Fleishman is a Partner resident in the New York office of Reid Collins & Tsai, LLP. Ms. Fleishman has litigated a broad array of complex commercial disputes in federal and state courts, including securities fraud class actions, breach of contract cases and common law fraud claims. Ms. Fleishman has also represented clients in connection with SEC, NASD and internal investigations. Representations handled by Ms. Fleishman currently, and at prior firms, include:
- Obtaining a settlement valued at approximately $200 million from a major accounting firm on behalf of a class of investors who alleged the accounting firm had marketed abusive tax shelters as legitimate tax planning products.
- Obtaining a $30 million settlement in a class action against a failed telecommunications company brought by investors who alleged the company had resorted to a variety of improper accounting tactics to misrepresent and conceal its financial condition, including channel stuffing and holding quarters open.
- Conducting an internal investigation of a financial services company to determine whether the company's practices with respect to handling abandoned property complied with applicable law.
- Representing the Special Committee of a Board of Directors investigating the merits of derivative claims alleging the company had paid an inflated sum to purchase resort hotels in an interested director transaction.
- Defending a family of hedge funds against breach of contract and fraud claims asserted by the former head trader of the hedge funds, and obtaining summary judgment dismissal of most of the claims.
- Ms. Fleishman has also represented employers in a number of different industries in restrictive covenant litigation against former employees.
Ms. Fleishman is a member of the Section on Litigation of the American Bar Association. She is a past Co-Chair of the Class Actions and Derivative Suits Subcommittee of the ABA. She is also a member of the New York City Bar Association.
Prior to joining Reid Collins & Tsai, LLP, Ms. Fleishman was a Partner with Milberg Weiss & Bershad, LLP, Special Counsel to Fried, Frank, Harris, Shriver & Jacobson, LLP and Counsel to Tarter Krinsky & Drogin LLP.
